Terms of Use
David Bernard Photography provides fine art portrait sessions, editorial fashion photography, and documentary-style environmental shoots. Each commission is defined by a written agreement outlining the session format, expected deliverables, and usage rights. Licensing of selected works for editorial or commercial purposes is handled separately and depends on the specific image and intended use.
Clients are responsible for providing accurate information about the intended use of photographs, including publication context and duration. For portrait sessions, clients must arrive at the agreed location on time and communicate any specific creative direction at least 48 hours before the shoot. Failure to do so may affect the final delivery schedule.
All photographs remain the intellectual property of David Bernard unless otherwise stated in a signed licensing agreement. Clients receive a personal usage license for commissioned portraits, which covers private display and personal sharing. Any commercial use, reproduction in print media, or public exhibition requires a separate written license. Unauthorized use of images, including cropping or altering without permission, is prohibited.
While every effort is made to deliver high-quality work, David Bernard Photography is not liable for indirect damages arising from the use or inability to use delivered photographs. This includes but is not limited to loss of business opportunity, reputation, or data. Liability is limited to the total amount paid for the specific commission or license in question.
Either party may terminate a commission agreement with written notice if the other party fails to meet the agreed obligations. Upon termination, the client is responsible for payment for work completed up to the date of termination. Any unused portion of a prepaid session is refunded within 30 days, minus a processing fee for administrative costs.
These terms may be updated periodically to reflect changes in practice or legal requirements. The current version will always be available on this page, and significant changes will be communicated via email to active clients. Continued use of the services after changes are posted constitutes acceptance of the revised terms.
